This website is operated by Anime 2nd Hand. Throughout the site, the terms “we”, “us” and “our” refer to Anime 2nd Hand. Anime 2nd Hand offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

This online shop is hosted on Shopify. Shopify provides us with the online e-commerce platform that allows Anime 2nd Hand to sell our products and services to you.

 

Definitions

Account: the electronic account you may choose to set up on the Website to track your Orders and save details such as your Delivery Address.
Customer: an individual using our Website to purchase Goods.
Contract: the legally-binding agreement between you and us for the supply of Goods.
Delivery Address: the Customer’s premises or any other location where Goods are to be delivered, as set out in an Order.
Goods: the goods advertised for sale on the Website, supplied to you of the number and description set out in your Order.
Order: the Customer’s order for Goods as submitted following the step-by-step process set out on the Website.
Website: our website www.anime2ndhand.co.uk, on which Goods are advertised.

 

Goods

  1. The description of the Goods is as set out in the Website or other form of advertisement (i.e. as present on social media). Any description or photograph of the Goods is for illustrative purposes only and there may be small discrepancies in the size and colour of the Goods supplied.
  2. All Goods which appear on the Website are subject to availability.
  3. We may make changes to Goods if necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
  4. Mystery bags (i.e. Lucky Boxes, Unlucky Boxes, Fukubukuro, and Themed Lucky Boxes) include unknown, mystery items. The contents of these sets are not disclosed and including one of these Goods in your Order means that you agree to this condition. Items found in these Goods cannot be returned or exchanged.

 

Personal Information

  1. We retain and use all information strictly under the Privacy Policy.
  2. We may contact you via email or other electronic communication methods for marketing purposes if you have expressly agreed to this.
  3. We may also contact you where it is necessary to communicate information regarding your Account or your Order(s).
  4. We do not accept orders from or offer accounts to individuals under the age of 16. Services provided by us are subject to the customer being over the age of 16.

 

Sale Conditions

  1. The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly and that all information given and choices selected are correct.
  2. A Contract will be formed for the sale of Goods ordered only when you receive an email from us confirming the fulfilment of the Order (e.g. an Order Shopping Confirmation email).
  3. Prior to fulfilment, we will provide an automated Order Confirmation. This confirms the placement of your Order. You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you.
  4. By placing an Order with us, you agree to us giving you confirmation of the Contract by means of an email with all information in it (i.e. the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Goods supplied within the Order.
  5. Prior to fulfilment, we may amend or cancel the order for any reason, including (but not limited to) availability of Goods, Customer request, and incorrect information.
  6. No variation of the Contract, whether description of Goods, Fees, or otherwise, can be made after it has been entered into unless the variation is agreed upon by the Customer and the Supplier in writing.

 

Price and Payment

  1. The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order.
  2. We endeavour to make sure correct pricing information is available, however we reserve the right to update pricing, reject or amend orders, or take any other actions necessary where prices shown were incorrect at any time.
  3. Prices and charges include any VAT applicable at the time of the Order.
  4. Promotional or sale prices are only available during the period of the promotion. These prices cannot be backdated to previous orders or honoured on future Orders places outside of the promotional period.
  5. You must pay by submitting your credit or debit card details via one of our payment gateways (e.g. PayPal) at the time of placing your Order and we will take this payment before delivery of the Goods.
  6. We reserve the right to amend or update prices and charges subsequent to the placement of an Order in the event that we become aware of pricing errors or substantial additional charges we will incur to fulfil the Order. If this occurs, we will endeavour to contact you to discuss how to proceed with any affected Orders.

 

Delivery Conditions

  1. We will contract a Postal Service to deliver the Goods to the Delivery Address without undue delay.
  2. Most orders are shipping within 2-4 working days (Monday-Friday) after a successful Order has been placed.
  3. Please note that during exceptionally busy periods, such as prior to public holidays or during sale periods, it may take longer to ship orders due to the number of orders being processed or the number of possible postal days being reduced.
  4. All Orders should be received within 3-5 working days of being shipped. Unfortunately, no compensation can be offered for deliveries that take longer than the estimated delivery time.
  5. If you or your nominated third party fail, through no fault of ours, to take delivery of the Goods at the Delivery Address, we may charge the reasonable costs of storing and redelivering them.
  6. The Goods become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them.
  7. Completion of delivery is determined as being when the Goods are delivered to the Delivery Address. This is based on the date and/or time that the courier or postal service used records the Goods as having being delivered.
  8. The courier or postal service may confirm delivery by updating tracking information, providing delivery confirmation, or other means of recording completion of delivery. This is considered to be proof of completion of delivery. In the event that the courier or postal service has recorded the Goods as delivery but the Customer does not believe this to be the case, we reserve the right to consider the Goods delivered unless proof can be obtained by the Customer to establish the delivery confirmation is incorrect.
  9. It is the responsibility of the Customer to provide information regarding the Delivery Address. We are not liable for any non-delivery or the non-receipt of any Goods if the information provided about the Delivery Address, the Customer, or their intended third party recipient at the Delivery Address is incorrect, partial, or false.

 

Risk and Title

  1. Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you.
  2. You do not own the Goods until we have received payment in full.

 

Withdrawal, return of goods, and cancellation

  1. You can withdraw the Order if you simply wish to change your mind and without giving us a reason, without incurring any liability, so long as you abide by the Shipping and Returns Policy.
  2. You can cancel your Order(s) by telling us within 14 days of the Goods having been received.
  3. Goods must be returned to us within 14 days of you notifying us of your intention to return them, or within 30 days if the Goods are found to be faulty, damaged beyond that mentioned in the listing, or not matching the description of the Goods.
  4. If you wish to cancel an Order without liability, you must return to the address listed in the Shipping and Returns Policy the Goods in undamaged condition at your own expense.
  5. We must without delay refund to you the cost of the Goods in question and the standard postage charges, not including any supplementary costs arising from the selection of a more expensive delivery cost than the standard delivery offered. This does not affect your rights when the reason for the cancellation is any defective Goods.
  6. In the event you receive defective Goods, please email info@anime2ndhand.co.uk, detailing the reasons for the return and including photographs where possible. Where Goods received are deemed defective, we will offer a refund for the cost of the Goods in question and the standard postage charges.
  7. We are unable to accept the return of Goods or offer any refund/compensation for Goods damaged during use by the customer. This includes accidental damage, mishandling of Goods, or damage sustained through normal use or aging.
  8. The cancellation period will expire after 14 days from the day on which you, or a specified third party, acquires the physical possession of the Goods.
  9. The cancellation period specifically for defective Goods will expire after 30 days from the day on which you, or a specified third party, acquires the physical possession of the Goods.
  10. If you wish to return any Goods, please email info@anime2ndhand.co.uk to let us know. Upon receipt of a returns request, you will be provided with our returns address again and instructions for the return.
  11. You are responsible for safely packaging the Goods and all items should be returned in an untampered and undamaged state, suitable for resale. Whether Goods are in a non-resaleable state will be determined exclusively at our discretion upon receipt of the returned Goods.
  12. An excessive number of cancellations may adversely affect your account. We reserve the right to refuse future Orders if the amount of cancellations is considered by us to be excessive.

 

Mystery Boxes

  1. Mystery (i.e. Lucky, Unlucky, Fukubukuro, Themed Lucky) boxes are sold as mystery sets of undisclosed items. The quantity and contents of these boxes are kept a mystery until receipt of a box by the Customer. A brief overview of the possible contents will be listed on the Website, but specific details are kept secret.
  2. Items contained within an Unlucky Box may be defective or not a part of any other series listed on the Website. These terms are listed in the description of said Goods, and the Customer accepts these terms upon purchase of an Unlucky Box.
  3. Fukubukuro boxes are old sold seasonally (in early January) and are subject to availability. These boxes will not be available throughout the year.
  4. Themed lucky boxes will have a running theme pertaining to the items included within. This theme may be a particular series, or a genre, or one character. This theme will always be clearly listed in the description of the Goods.
  5. A Customer purchasing any of these mystery boxes accepts these terms and understands that the items contained within any mystery boxes cannot be returned or exchanged.

 

Conformity

  1. We have a legal duty to supply the Goods in conformity with the Contract, and will not have confirmed if it does not meet the following obligation.
  2. Upon delivery, the Goods will:
  3. be of satisfactory quality;
  4. be reasonably fit for any particular purpose for which you buy the Goods which, before the Contract is made, you make known to us, and be fit for any purpose held out by us or set out in the Contract; and
  5. conform to their description as best as possible.
  6. It is not a failure to conform if the failure has its origin in your materials or subsequent handling of the Goods.

 

Circumstances beyond the control of either party

  1. In the event of any failure by a party because of something beyond its reasonable control:
  2. the party will advise the other party as soon as reasonably practicable; and
  3. the party’s obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer’s above rights relating to delivery and any right to cancel.

 

Privacy

  1. Your privacy is important to us. To respect your privacy and meet legal requirements regarding your personal information, we comply with the General Data Protection Regulation (GDPR).
  2. These Terms and Conditions are in addition to, and should be read alongside, our Privacy and Cookie Policy.

Excluding liability

  1. The Supplier does not exclude liability for: (i) any fraudulent act or omission; or (ii) for death or personal injury caused by negligence or breach of the Supplier’s other legal obligations. Subject to this, the Supplier is not liable for (i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (e.g. loss of profit) to the Customer’s business, trade, craft, or profession which would not be suffered by a Consumer – because the Supplier believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft or profession.

 

Governing law, jurisdiction and changes

  1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.
  2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
  3. We may change our terms and conditions at any time. Please do not assume that previously agreed terms apply to future Orders.
